    The residents of Hubbard County have the great fortune of living among the beauty of the woods and waters. From the towering pine trees to the many pristine lakes, rivers and wetlands, the county has some of the most unique natural resources in Minnesota. These precious resources must be protected to maintain the high quality of life we have come to enjoy.

    The Hubbard County Shoreland Management Ordinance governs all properties within 1000 feet of a classified lake and 500 feet from a classified river. If you own, or are thinking of purchasing land within these boundaries, keep in mind that in many cases a permit or other authorization is required through this office prior to beginning construction. The scope of our office is to enforce the Hubbard County Shoreland Ordinance, County Land Use Ordinances, individual sewage treatment systems, and the Wetland Conservation Act.

    In doing so, this office is responsible for the issuance of all required permits, processing of variance and conditional use applications, inspections of sewage treatment systems, subdivision and/or platting of land, wetland regulations, and ensuring that the quality of life we enjoy, is passed on to future generations.

VARIANCES

    Where there is unnecessary hardship in carrying out the provisions of the Hubbard County Shoreland Management Ordinance, an appeal may be made, and a variance may be granted by the Hubbard County Board of Adjustment.

    An applicant desiring a variance shall submit an application for variance appeal form available online at this web site or from the Environmental Services Office. Along with the completed application and the appropriate non refundable fee, the applicant must also submit a copy of their deed, directions to the property and a plan drawn to scale or dimension showing the desired variance. Deadlines for variance appeal applications are posted on this web site and also are available at the Environmental Services Office.

    The Board of Adjustment is comprised of 5 individuals, 1 from each Commissioner District, appointed by the respective County Commissioner. Variance appeals are heard on the 3rd Monday of each month, from April – November at 9:00 am at the Hubbard County Courthouse. Lot viewals for the respective variances are held on the Thursday prior to the hearing date, and if needed, also on Friday. It is recommended that an applicant or their representative is present at both the lot viewal and the hearing.

 


SEWAGE TREATMENT STANDARDS

    Any premises used for human occupancy must be provided with an adequate method of sewage treatment.

    Publicly owned sewer systems must be used when available.

    All private individual sewage treatment systems must meet or exceed all provisions of the Hubbard County Individual Sewage Treatment Standard Ordinance and the current edition of the Minnesota Rules, Chapter 7080 in all respects, which is hereby adopted by reference and declared to be a part of the Hubbard County Shoreland Management Ordinance.

    All soil absorption areas (drainfields) must be setback a minimum of 150 feet from the ordinary high water level. The bottom of trenches and beds shall be at least 4 feet above the water table, restricting layer or bedrock.

    Any property owner may install their own system that services their residence, as long as an approved site evaluation and design has been submitted by a licensed contractor and a permit has been issued. A licensed contractor must install a system that services a commercial establishment.
